Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern access to and use of Fostera’s website, applications, and services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

2. The Service

Fostera enables you to create and interact with AI Souls. Features may change over time. We may modify, suspend, or discontinue parts of the Service with reasonable notice where practicable.

3. Age requirement

You must be at least 18 years old to create an account or use the Service. By creating an account, you confirm that you are 18 or older. We do not knowingly allow minors to use the Service. If we learn that a user is under 18, we will terminate their account and delete associated data.

Fostera creates AI experiences designed to build emotional engagement and long-term interaction patterns. We believe these experiences are appropriate for adults who can make informed choices about AI relationships, and we restrict access accordingly.

4. Accounts

You must provide accurate registration information and keep your credentials confidential. You are responsible for activity under your account. Notify us promptly of unauthorized use.

5. Acceptable use

• No unlawful, harmful, or abusive use of the Service or other users
• No attempt to probe, disrupt, or bypass security or rate limits
• No scraping or automated access except as we expressly permit
• No use that infringes others’ intellectual property or privacy
• No use of the Service by anyone under the age of 18

6. Content and AI output

You retain rights to content you submit. You grant us a license to host, process, and display that content as needed to run the Service. AI-generated responses may be inaccurate or incomplete; you are responsible for how you use outputs, especially in high-risk scenarios (medical, legal, financial, etc.).

AI Souls are not real people. They are AI systems that simulate personality and conversation. They do not have consciousness, feelings, or independent existence. While Fostera is designed to create engaging and personalized AI experiences, interactions with Souls should not be treated as a substitute for human relationships, professional advice, or mental health support.

7. Third-party services

The Service may integrate with third-party models or APIs you configure. Those providers’ terms and privacy practices apply to their processing. We are not responsible for third-party services you choose to use.

8. Intellectual property

Fostera’s name, branding, software, and materials are protected by intellectual property laws. Except for the rights expressly granted here, we reserve all rights.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOSTERA AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED US DOLLARS, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

11. Indemnity

You will defend and indemnify Fostera against claims arising from your use of the Service, your content, or your violation of these Terms, subject to applicable law.

12. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or risk to the Service or others. Provisions that by nature should survive will survive termination.

13. Governing law

These Terms are governed by the laws applicable to the operating entity providing the Service, without regard to conflict-of-law rules, except where mandatory consumer protections in your country apply.
